Purchase contract

In a purchase contract, the purchase of a house, an apartment or a holiday home by a private buyer is recorded. When both the buyer and the seller come to an agreement on the purchase, they need to record this in writing.

In the purchase contract, the seller and the buyer record that a house or apartment shall be the property of the buyer, under certain conditions, at a certain price on a specific date. The seller also has to provide information about the conditions of the house, to ensure the buyer is well informed on all important characteristics of the property. On the other hand, the buyer has to specify for what purpose he would like to buy the house. The buyer of the property will not be the owner of the property after signing the purchase contract yet. The ownership of the property will be transferred by the notarial deed of transfer. 

Although in practice real estate agents also draw up purchase contracts, we would be happy to assist you to draw up such a contract. This ensures that you have the required expert legal support and advice.

As a buyer, you will receive a copy of the purchase contract signed by the seller. At this moment a three-day cooling-off period starts. During this period you can inform the seller, without having to state a reason, that you want to terminate the purchase contract. You can agree with the seller about a longer cooling-off period. A shorter period is not possible.


Registration purchase contract

Each purchase contract for real estate can be registered in the public registers of the Land Registry Office. This registration protects the buyer against any contingencies that may affect the seller, such as bankruptcy, attachment of the house or a higher bid. This registration has effect for six months and has to be done through a civil-law notary.
