Deed of transfer
The deed of transfer is drawn up by the notary on the transfer of homes and business premises. The agreements included in the deed must correspond to the agreements in the purchase agreement, as made between the seller and buyer.
About the Deed of transfer
Signing the purchase agreement is not enough to become the legal owner of a house. When buying a house, you only become the owner of the house when it is delivered to you. This is done through a deed of delivery at the notary. A deed of delivery is also called a deed of conveyance or deed of delivery.
After preparing the deed of delivery, the notary will go over it with the buyer and the seller. After this, the deed of delivery will be signed by the buyer, the seller and the notary. After signing, the deed of delivery will be registered in the Land Registry. After the registration, the buyer is registered as owner in the Land Registry and is visible to everyone.
Control by notary
To prevent things from going wrong when selling the house, we always carry out a number of checks. If this is not done, there is a possibility that the house is sold by someone who is not authorized to do so or that the plot and the house are not correctly described. If this is the case, the house cannot be delivered to the buyer.
The notary verifies, among other things:
- Who owns the house;
- Whether there are herds on the house;
- Whether all legal conditions regarding the purchase of a home have been met;
- Whether the plot and property are properly described.
When the buyer, the seller and the notary have signed the deed of transfer, we register the deed of transfer at the public registers of the Land Registry and the transfer of ownership is complete. From then on, the buyer is the new owner of the house.
