Wwft office policy Marks Wachters notaries

Under the Prevention of Money Laundering and Financing of Terrorism Act (WWFT), notaries are required to conduct a client due diligence and an investigation into the origin of funds. Notaries also have a reporting obligation when there is a suspicion of money laundering or terrorist financing. This obligation applies, among other things, to cases involving real estate, such as a home or business premises.

Client survey

Clients of Marks Wachters notaries must identify themselves to the notary. We also ask our clients to fill out a PEP statement for financial transactions, to determine whether there is a (close relationship with a) person with a politically prominent position. On this basis, we can determine whether we need to take extra care because of a possible increased risk of fraud.

In addition, it must be possible to establish the identity of the beneficial owner of legal entities such as an association, foundation or limited liability company. We ask these corporate clients to provide a UBO statement.

Origin of funds research

When a client deposits money into a notary's account, we are required to verify where the money came from. The money may not originate from criminal activities. In addition, as notaries, we are not allowed to accept amounts above €2,500 in cash.

Notification

If the notary suspects that a transaction is unusual or could be related to money laundering or terrorist financing, we report it to the Unusual Transactions Disclosure Office (FIU-Nederland). The civil-law notary himself decides whether a situation is suspicious. He does not have to inform his client.

What do we ask of you?

Buyers who use their own funds (e.g. savings) for the purchase must be able to prove how they obtained the money. In addition, a legal entity would be wise to have matters in order in the commercial register (think about registering the correct directors and proxies) and to use its own checking account for transactions. The delivery of the property will not take place if, in the opinion of the notary, things are not in order.
