Buying an apartment

An apartment right is purchased when you buy real estate that is part of a larger building, such as an apartment building. This means that legally you are actually purchasing two things with the apartment right: a co-ownership of the entire building and the right to use your home, the apartment.

Apartment rights can vary in size and shape and do not only refer to the apartment itself. For example, it can also involve a park with vacation homes or a large complex with stores and homes.

The apartment right

All apartment owners together also own the entire building. As a co-owner, a resident may therefore use all common areas. These common areas include a courtyard, roof terrace, stairwell or hallway. There are also rules that all owners must follow. It is important to know in advance what the responsibilities of the owners are, what house rules apply and how much it costs to manage the common areas. Don't be surprised by this afterwards!

Division of apartment rights

Apartment rights are created by dividing a building into smaller areas of use. Legally this is called: division into apartment rights. The notary draws up a so-called division deed and then enters it in the public registers of the Land Registry. One of the most important parts of the division deed is the regulations of the division. This contains rules of conduct for owners and residents.When you buy an apartment, you often receive three documents:

  • A property deed;
  • A subdivision deed;
  • A subdivision regulation.

Property deed apartment

A title deed is the proof of ownership of the apartment. The title deed states who the buyer and seller are and the sale price of the apartment. It also lists any rights in rem, such as the right of way and other easements.

Split deed

An apartment right results from a building being divided into smaller use areas. This is legally called ‘division into apartment rights.

A subdivision deed lists the private and common parts of the complex. The division deed contains a division drawing showing the division of the complex. The division deed and the division drawing are registered in the Public Registers of the Land Registry. 

Split Rules

Another important part of the subdivision deed is the rules of subdivision. These contain rules of conduct for owners and residents, as well as how and how often the owners' association meets and by how many votes a decision in the owners' association is approved.
