One of the things you may have to deal with when buying or selling a commercial property is VAT. You have to pay VAT when you buy a new property or buy a property that was put into use less than two years ago. A building that has been in use for more than two years is exempt from VAT.
Business and residential space
When you buy a property that you use as both business property and residential property, you can choose to have all or part of the property counted as private property or business property. This is possible when the residential and business parts of the property cannot be physically separated.
If the living area is physically separable from the business area, the living area cannot be included in the business assets. In the event of a subsequent sale, you will then owe VAT only on the business portion and not on the residential portion.
If the property cannot be divided into residential and business sections, then you can choose to count it as private assets or business assets.
- Do you choose business assets? Then the input tax is deductible.
- Do you choose private equity? Then you cannot deduct input tax. You will not owe sales tax on any subsequent resale.
