Cohabitation Contract
A cohabitation contract (or cohabitation agreement) allows you to arrange which assets belong to you and your partner together. If you live together, without being married and without entering into a registered partnership, there is nothing regulated for you in the law.
Drawing up a cohabitation contract
With a cohabitation contract, also known as a cohabitation agreement, you can arrange which possessions belong to you and your partner together. If you are going to buy a house and live together, it is important to arrange things properly. If you do not want all of your assets and debts to belong to you separately, you can have a cohabitation contract drawn up by Marks Wachters notaries.

Private cohabitation contract
It is possible to draw up a private cohabitation contract, but in order to qualify for certain inheritance tax exemptions within 5 years of the start of cohabitation and to be entitled to a partner's pension after death, you need a cohabitation contract that must be drawn up by notarial deed.
Terminating a cohabitation contract
You can terminate a cohabitation contract at any time. Breaking a cohabitation contract is (almost) always done because one of the partners wants to end the relationship. To terminate the cohabitation contract, you don't have to visit the notary.
However, there are things that run outside the cohabitation contract that you need to pay attention to, such as joint ownership of a home. Both partners remain joint owners of the home even though the cohabitation contract has ended. Ownership of the home can be transferred to one of them with a deed of conveyance.
